Two protesters have climbed over the balcony of a hotel in Sydney that's hosting a
mining conference to unfurl a banner against coal and gas expansion in NSW.

A woman in a business suit and a man wearing a bowler hat remain suspended from the
Sofitel Wentworth Sydney hotel in Sydney's CBD, as around a dozen police officers wait
at street level for them to come down.

About 50 farmers and rural community members are at the protest against the NSW Minerals
Exploration and Investment conference.

BRISBANE, April 21 AAP - Queensland's Court of Appeal has dismissed former Bundaberg
surgeon Jayant Patel's appeal against his seven-year sentence for manslaughter and causing
grievous bodily harm.

In July 2010 Patel was jailed for seven years after a jury found him guilty of the
manslaughter of Gerry Kemps, 77, James Phillips, 46, and Mervyn Morris, 75.

He was also found guilty of causing grievous bodily harm to Ian Rodney Vowles, 62.

The convictions relate to his time as a surgeon at Bundaberg Hospital between March
2003 and April 2005.

The court also dismissed the attorney-general's appeal calling for a tougher sentence
of more than 10 years.

Mr Vowles said he feared that Patel would get a lesser sentence.

"That was a possibility, I'm glad commonsense overruled," he told journalists in Bundaberg.

Patel caused grievous bodily harm to Mr Vowles when he "whipped out" his bowel during
an operation in October 2004, despite it not showing signs of cancer.

Mr Vowles said he'd suffered a range of complications after the bowel surgery - he
became impotent, had a livid scar, couldn't return to work for months and was forced into
early retirement, and had to use an ileostomy bag.

He said it's been a traumatic few years living with the repercussions of the operation
as well as during the trial.

"You don't know how much it's affected you until you go through the court case and
everything is finalised, it's a load off your mind," he said.

"(I feel) relief, happiness, it's just a good feeling that everything is finally over."

Gerry Kemps' wife, Judy, also spoke to the media in Bundaberg with Mr Vowles and Bundaberg
Hospital Patients' Support Group president Beryl Crosby.

During the trial the court was told Mr Kemps died after Patel performed an oesophagectomy.

The crown alleged Patel rushed into the surgery without proper planning, and then failed
to diagnose internal bleeding.

Ms Kemps let out a big "Yes!" when the judgment was handed down.

"I was happy with the result," she told reporters.

"Now I know everything is over, I have such peace of mind."

"He can't do it again, he can't go and do the same thing that he's done to our patients
here anywhere else."

The judgment came on Thursday seven weeks after Patel's legal team argued before Court
of Appeal judges that their client did not get a fair trial.

Ms Crosby said it was a tense time waiting for the appeal.

"It's very much relief, I mean everybody was a bit on tenterhooks," she said.

"We've had a harrowing time here over the years.

"It's always sweet when we win because we fought for so long."

Patel is still facing eight fraud charges over the ordeal.

AFL:Sick Selwood finally home

BRISBANE, Aug 24 AAP - A sickening clash that suddenly drew the curtain on his time
with the Brisbane Lions was bad enough, but what happened next really hurt Troy Selwood,
according to coach Michael Voss.

"He was pretty devastated that he couldn't sing the team song, that was his major thing
in the end," Voss said on Tuesday.

Instead of sharing a rare victory with teammates at Etihad Stadium on Sunday, Selwood
was hospitalised with rib cartilage damage caused by a collision with Essendon's Kyle
Hardingham - an injury that kept him bed-ridden until Tuesday.

Selwood is expected to make a full recovery but will miss Brisbane's finale against
Sydney on Saturday night at the Gabba.

"He is sore but that's what happens when you almost get split in half," Voss said.

"Thankfully it is not a fracture, we are expecting him back today."

As he waited for the midfielder to fly back into Brisbane, Voss spoke of how difficult
it was to pull the pin on Selwood's stint at the Lions.

A mad Fitzroy fan as a kid, Selwood made his AFL debut for the Lions in 2005 but battled
injury throughout his time at the club.

"This time of year is never that pleasant for a coach, and for players in that situation
- it's not the most enjoyable time," Voss said.

"We had a conversation last week, and I spoke to him about what his future held and
he was tossing up what he was going to do.

"The best way we thought for him to finish was play in the seniors - he had earned
that right anyway.

"But I thought it gave him the opportunity to finish the way he should.

"And he should be acknowledged for his time here and the worthwhile contributions he
has made to this football club.

"I knew it was the right thing, and I know he appreciated it - it just didn't end in
the fairytale that we hoped."

But it did end with Selwood's trademark bravery - typified by his horrific head clash
with Richmond's Alex Rance in round seven last year.

Voss hoped the axing did not mark the end of Selwood's AFL career.

"He has been an outstanding person for such a long time for our club - the boys love
him," Voss said of Selwood, whose brothers Adam, Joel and Scott also play AFL.

"He was quite positive about it (axing). He was looking at different things for where
he goes next - I am sure one of those options is continuing to play."

SYDNEY, April 16 AAP - The test for HIV, a development that changed the trajectory
of the AIDS illness globally and saved countless lives, arrived in Australia 25 years
ago this week.

The antibody test for Human Immunodeficiency Virus (HIV) was released to a public spooked
by the rapid emergence of a strange and deadly disease in mid-April of 1985.

It arrived four years after the world's first cases of Acquired Immune Deficiency Syndrome
(AIDS) were detected in the US, and more than two years after Australia recorded its first
AIDS case in November 1982.

"When I started working with HIV in the mid-80s, quite a lot of people within a short
period of time knew somebody with AIDS," said Levinia Crooks, chief executive of the Australian
Society for HIV Medicine (ASHM).

"... And not a long time after that, a lot of people had known somebody who had died of AIDS.

"Then we went to `Grim Reaper` (ad campaign) days, when people were madly getting tested
and were very, very concerned."

HIV was identified as the viral precursor to AIDS in 1984 and a test capable of detecting
HIV soon followed.

It has become one of Australia's most widely used tests with 40 per cent of the adult
population estimated to have had it at least once.

A HIV test is routinely offered to planning or newly pregnant women and people undertaking
STD tests, while it is a requirement for those applying to enter the armed forces and
other jobs.

A 2008 study found 80 per cent of gay men in Australia had undergone at least one HIV
test, while a third of all gay men have the test every six months.

Australia now performs about 900,000 HIV tests every year, a level that Ms Crooks described
as "good".

"That doesn't mean that it couldn't be better, and there may be some people who may
never have been tested," she said.

"But looking at a population level, I think there has been a remarkable uptake of testing."

Australia has recorded less than 30,000 HIV infections since records began, and the
number of new cases has plateaued at about 1,000 every year.

Ms Crooks said the ready access to HIV testing and advanced treatments for those with
HIV - which could delay or even prevent the onset of AIDS - had "hugely" changed the impact
of the virus on Australia.

HIV and AIDS had gone "off the radar" as a mainstream health issue in the eyes of the
public, she said.

"That's in our microcosm, but when you look globally you haven't got to look far to
see environments where HIV is very much still out there, and where testing is limited
or unavailable or very costly and not able to be accessed," Ms Crooks said.

"Papua New Guinea has a very high rate of HIV (transmission) in comparison, and testing
is very expensive."

Australia's northern neighbour has the highest incidence of HIV in the Pacific region,
after recording its first case in 1987.

It is estimated that two per cent of PNG's adult population, about 64,000 people, are
HIV positive and this is projected to top 500,000 within 15 years.

"The good thing in Australia is we've always had free and anonymous testing," Ms Crooks said.

"When people are tested, if they find out they have HIV, the response overwhelmingly
is concern about who they might have given it to and concern to not give it to anyone
else."

MELBOURNE, Dec 19 AAP - A heroin addict who bashed and tried to strangle his own grandmother
for $60 has been jailed for four and a half years.

Desperate for money for his next hit, Brett Andrew Dolan, 36, attacked his grandmother
Patricia Mary Inglis, 79, as she lay in her bed in her Braybrook home in March.

He grabbed his grandmother by the legs and dragged her down the bed before picking
her up and throwing her roughly back down, the Victorian Supreme Court was told.

He then hit her with a pillow and attempted to strangle her.

The grandmother eventually gave in and handed over $60.

Dolan spent the money on heroin.

A week later, Dolan rang his grandmother saying he was going to kill her for calling the police.

He was initially charged with attempted murder over the attack, but he pleaded guilty
to the lesser charges of robbery, recklessly causing injury, making a threat to kill and
possessing a drug of dependence.

Justice Elizabeth Curtain on Friday jailed Dolan despite Ms Inglis saying she was sorry
she'd called the police and fears she may never see her grandson again outside prison.

"These were crimes which offend any standard of decency, a cowardly assault on an elderly
woman, not only in her house, but in her bedroom," Justice Curtain said.

"Your elderly grandmother, who had given you love and support over the years and shelter
in your time of need, was robbed and assaulted in her own home so you could get money
for your next hit.

"It is difficult to imagine more reprehensible conduct."

In a statement to the court tendered earlier this week, the grandmother said: "I'm
feeling responsible that he is facing a possible prison sentence and I wish I had not
called the police at the time."

Dolan must serve a minimum of two years' prison.

BRISBANE, Aug 14 AAP - Queensland's South Burnett region is closer to developing the
biggest wind farm in the southern hemisphere after the project received "overwhelming"

community support.

The $1.2 billion project called the Coopers Gap Wind Farm is being proposed for 12,000
hectares of cattle grazing country located almost midway between Kingaroy and Dalby in
south-east Queensland.

International specialist banking group Investec Bank and Windlab Systems, established
by the CSIRO, will lodge a development application to build 252 wind turbine generators
after successful feasibility studies and community consultations at the weekend.

Richard Castellari from Investec's project development team said the company planned
to build 12 wind farms across Australia and New Zealand, with Coopers Gap Wind Farm being
one of three closest to fruition.

"We had overwhelming support for the project from the community and the local council,
with really no objections," Mr Castellari said.

"The wind farm will cover between six and 10 properties.

"The area has really good internal wind speed, is near a transmission network, a network
that distributes power, and from the fauna and flora perspective it's quite benign - there's
no flora or fauna of great significance - it's cattle grazing land."

BRISBANE, April 5 AAP - A notorious sex offender has been remanded in custody charged
with the rape of a 61-year-old woman on the Gold Coast.

Robert John Fardon, 59, appeared in Brisbane Magistrate's Court today charged with
rape, assaulting a person over 60 years and administering a stupefying drug with intent
to commit an offence.

Police said the victim was allegedly attacked at her Palm Beach home on Wednesday morning.

Magistrate Noel Nunan remanded Fardon to reappear in Southport Magistrates Court on
April 14 for mention.

Fardon has spent most of his life in prison for violent sex offences. He was the first
Queensland prisoner to be kept in jail under a continuing detention order after serving
his full sentence in 2003.

He was released under a 10-year supervision order in 2006, but was taken back into
custody in July last year after breaching the order by travelling to Townsville.

He was released again in October under a stronger order and will appear in Brisbane
Supreme Court on Monday charged with two counts of breaching the conditions.

Allegations of another breach have sparked public debate about whether the Dangerous
Prisoners (Sexual offenders) Act Orders offer any real protection to the community.

News Limited today reported a list of 30 Queenslanders subject to the special orders.

It said a second notorious sex offender, convicted pedophile Mark Anthony Foy, was
also being questioned over the alleged rape.

However, neither police nor Police Minister Judy Spence would confirm whether Foy was
being questioned.

One of the conditions on the order is that convicted sex offenders should not associate
with each other.

Outside the court, Queensland Prison Officers Association vice-president Steve Burrows
expressed anger that the state government was ignoring their warnings about Fardon, claiming
he had been associating with Foy for some time.

"It is distressing for our members that our constant warnings go unheeded," Mr Burrows
told reporters.

"(We deal) with these people 12 hours a day. Psychologists and counsellors spend 10
minutes with them once every three months."

Queensland Opposition leader Lawrence Springborg yesterday called for the resignation
of Ms Spence, who last year promised Fardon would be "watched like a hawk" upon release.

"If it transpires that this character has committed a serious offence and harmed an
innocent Queenslander whilst being 'watched like a hawk' by the minister for police, then
the minister has no choice but to resign," Mr Springborg said.

But Ms Spence said the state government was doing all it could to monitor sex offenders
like Fardon, who wore an electronic surveillance bracelet.

"We have the toughest legislation in Australia," she told reporters yesterday.

"We are learning all the time. This legislation is only five years young and we continue
to refine how we supervise people."

be part of the new Rudd government.

Ms McKew has been sworn in as parliamentary secretary to the prime minister and cabinet
with special responsibility for early childhood education and child care.

"It's wonderful to be joining the national parliament at a time when there is a new
government, a new prime minster and an invigorating fresh agenda for change," Ms McKew
said as she passed through the ministerial entrance of Parliament House today.

Ms McKew, who ousted former prime minister John Howard from his northern-Sydney seat
of Bennelong, said she already had homework.

"I've got the early childhood area and early childhood learning and childcare and that's
at the centre of Kevin's education revolution," she said.

"There's a huge number of things there, a lot of election commitments about the provision
of 15 hours a week for every four-year-old in the country and 260 new childcare centres.

"It's a big area, I've got one huge briefing document here and I am about to get more."

Ms McKew claimed victory in Bennelong on Saturday after deciding not to wait for Mr
Howard to concede defeat.

"I'm not waiting for that no," she said.

Mr Howard, who represented the electorate for his entire 33 year-parliamentary career,
has become the second prime minister - after Stanley Bruce in 1929 - to lose his seat
at a general election.

MELBOURNE, Dec 19 AAP - A Coles supermarket in Victoria has been fined $20,000 after
chapattis nibbled by mice were found on sale.

Coles Supermarkets Australia pleaded guilty in the Melbourne Magistrates' Court last
Thursday and was fined $20,000, Port Phillip Council said today.

The supermarket, in Bay Street, Port Melbourne, also had to pay the council's legal
costs of $3,500.

The fine came after a complaint to the council in May this year from a customer.

Shelves were checked and chapatti wraps nibbled by mice were still on the shelf for
sale, the council said.

Scott Whiffin, from Coles Myer, said the organisation accepted the outcome.

"All through this process we've worked with the council to address the issue and we're
confident the problem no longer exists," he said.

Asked whether it was disappointing that the court action came soon before Christmas,
a traditionally busy time for food retailers, he said: "It is disappointing it would happen
any time."

Port Phillip mayor Janet Bolitho said it was regrettable the supermarket had sold unsuitable
food.

She said Coles had fully complied with an improvement order and she was happy that
council officers had responded to the issue quickly.

BRISBANE, Aug 11 AAP - Hundreds of children were taken home from a Brisbane school
today after a suspicious substance was found in a toilet block, only days after rat poison
was planted in a playground.

Classrooms at the Sacred Heart School primary in Sandgate were left almost empty after
a small amount of green pellets, possibly Ratsak, was found by a student in the boys'
toilets about 7.50am (AEST) today.

Only 50 of the 300-strong school population remained at the school in Brisbane's north
after parents were told of the find.

Ratsak was discovered at the Kidspace Playground in the northside suburb of Chermside
on Tuesday after a crudely written note was found on a powerbox in nearby Nundah.

The note told of the poison's location and challenged police to find more poison at
three unspecified Brisbane schools.

Police said there was no evidence the latest find was linked to the Chermside incident,
fearing it could be the work of a copycat.

"At this stage there is no evidence linking this incident with the main offence that
started off this protracted investigation," acting Detective Chief Superintendent Ross
Barnett said.

"However, this incident, as with all others where there is the depositing of poison
in the community, will be thoroughly investigated by the police.

"Police will vigorously pursue any copycat who may be responsible for causing unnecessary
fear and disruption to the community."

Police are yet to charge anyone over the Chermside poisoning scare and have so far
interviewed six adult suspects.

Supt Barnett said the pellets found at the school appeared to be the same as those
found at the Kidspace Playground.

He said the person responsible would have only had a small window of time to plant
the substance in the toilets, with the block locked at 4pm yesterday and reopened at 7am
today.

Those responsible for the incident faced penalties of up to 14 years' jail, he said.

"The mere placing of a substance, if it is a poison, this morning is a very serious
act in its own right, even if it's intended to be a copycat (act)," Supt Barnett said.

Brisbane Catholic Education spokesman Darrin Davies said the school was proud of the
student for notifying teachers of the find.

"We have had a renewed state of vigilance since Tuesday of course, but as part of that
we have alerted children to the dangers of any suspicious substance and that paid off
this morning," he said.

CANBERRA, April 5 AAP - The Mental Health Council of Australia has welcomed the federal
government's mental health package but says more needs to be done to combat the crisis.

Prime Minister John Howard today announced a major funding boost to mental health services,
promising $1.8 billion over the next five years.

Council chief executive John Mendoza said the government package was a desperately
needed first step to help tackle Australia's mental health dilemma.

But he argued more initiatives were needed to help Australians with mental illnesses.

In particular, he said semi-residential institutions were needed to help relieve pressure
on hospitals currently caring for patients whose condition was not life threatening.

"We welcome the leadership of John Howard in responding to the crisis," Mr Mendoza said.

"We have data that indicates up to 30 per cent of all acute care beds around the nation
in the psychiatric ward of our hospitals are occupied by people who are not acute."

Mr Mendoza also called on the state governments to step up and release details of their
own mental health packages.

"The next critical step is for state and territory governments to come froward with
their own ideas and money," he said.

The New York Times Co. has said that it would raise advertising rates about 5 percent at The New York Times next year and to spend at least $40 million on previously announced employee cutbacks.The company released the figures as part of its guidance for Wall Street analysts and investors. The company did not provide an earnings estimate or a revenue forecast for the fourth quarter, or for 2006.The company, which owns the International Herald Tribune, said it would provide a fourth-quarter forecast later in December.''Given the limited visibility on advertising in 2006, the company is not providing an expected range for earnings, revenue growth or expense growth,'' the company said Tuesday in a statement.The chief executive, Janet Robinson, said in the statement that ''the media marketplace has been challenging in 2005 and we expect it will continue to be next year.'' Like other newspapers, The Times is struggling to hold on to readers and advertisers in the face of increased competition from the Internet.The company said its advertising revenue would increase ''in the low single digits'' for 2005, and circulation revenue would be ''flat to down slightly.'' The company did not provide a similar forecast for 2006.The Times Co. is also facing substantially higher prices for newsprint and the cost of building a new headquarters. In its statement, the company predicted that newsprint costs would rise at least 11 percent in 2006, after an increase of at least 8 percent this year. In the last year, analysts have reduced their forecasts for the company's 2005 earnings by about 30 percent, and its stock has slipped. On Tuesday, shares of The Times Co. closed down 23 cents at $26.61, their lowest level in seven yearsThe company also said About.com, a Web site acquired in March, would have double-digit revenue and operating income growth in 2006.

NSW: New premier says on-time trains are top priority

SYDNEY, Aug 4 AAP - On his first full day in office, NSW Premier Morris Iemma has been
briefed on his highest priority issue -- getting Sydney trains to run on time.

Mr Iemma met with Transport Minister John Watkins and rail chiefs to discuss a new
CityRail timetable which will begin next month.

The premier said he would ask rail executives for precise details of their on-time
running targets and plans to improve those targets.

He also wants to bring forward infrastructure upgrades and improvements to the system.

"A million people use the CityRail system every day," Mr Iemma told reporters at Sydney's
Central station.

"This is why, as premier, fixing this is my top priority."
